Until August, 2021, the three people heard about the relevant policies to persuade people staying in high-risk areas abroad to return to China, and after returning to their original places, they took the initiative to report to the local public security organs.

During the trial, the court examined the basic facts of the case in accordance with the law, and asked and listened to the defendant’s opinions and statements on the facts, evidence, sentencing suggestions and applicable procedures accused by the public prosecution agency, which fully guaranteed the rights of the participants in the proceedings.

It was found through trial that the defendants Li Moumou, Su Moumou and Yang Mou violated the national (border) management laws and regulations, and for the purpose of working abroad, under the arrangement of others, they ganged up and crossed the border, and their actions constituted the crime of crossing the border illegally. According to the criminal facts, circumstances and repentance of the three defendants, the court made a first-instance judgment in court, and sentenced the three defendants to fixed-term imprisonment ranging from six months to seven months and fined them.

"We have realized the mistake and regret our original decision very much. If we have another chance to come back, we will never smuggle again, and we will definitely turn over a new leaf." In the final statement of the trial site, three defendants repented in court, which deeply touched the observers.

After the verdict was pronounced, the three defendants expressed their obedience to the court’s judgment and did not appeal.

Article 318 Whoever organizes others to cross the country (border) illegally shall be sentenced to fixed-term imprisonment of not less than two years but not more than seven years and shall also be fined; Under any of the following circumstances, he shall be sentenced to fixed-term imprisonment of not less than seven years or life imprisonment, and shall also be fined or confiscated:

(1) The ringleader of a group that organizes others to cross the country (border) illegally;

(2) Organizing others to cross the country (border) for many times or organizing others to cross the country (border) with a large number of people;

(3) Causing serious injury or death to the organized person;

(4) depriving or restricting the personal freedom of the organized person;

(5) resisting inspection by violence or threat;

(six) the amount of illegal income is huge;

(seven) there are other particularly serious circumstances;

Whoever commits the crime mentioned in the preceding paragraph and commits such criminal acts as killing, injuring, raping, abducting and selling the organized person, or killing or injuring the inspectors, shall be punished in accordance with the provisions on combined punishment for several crimes.

Article 322 Whoever, in violation of the laws and regulations on the administration of the state (border), illegally crosses the state (border), if the circumstances are serious, shall be sentenced to fixed-term imprisonment of not more than one year, criminal detention or public surveillance and shall also be fined; Whoever steals across the country (border) for the purpose of participating in terrorist organizations, receiving training in terrorist activities or carrying out terrorist activities shall be sentenced to fixed-term imprisonment of not less than one year but not more than three years and shall also be fined.
